Driving on Suspended or Revoked License

VA Code 46.2-301
No resident or nonresident whose license has been suspended or revoked or who has been directed not to drive by a court Commissioner of D.M.V., etc. can drive a motor vehicle until the suspension or revocation has terminated.

Penalties:

  • 1st Offense: Class 2 misdemeanor (up to 6 months in jail, fine up to $1000)
  • 2nd or Subsequent: Class 1 misdemeanor (up to 1 year in jail, fine up to $2500)
  • License suspension for period for which it had been previously suspended or revoked when person violated this section. If suspension period or revocation is not for a definite period, suspension not to exceed ninety days. Suspension commences upon expiration of the previous suspension or revocation.
